1. Scope of Applicability
These Terms and Conditions apply to all contracts, bookings, and services provided by Lars Boob – amema.at (hereinafter referred to as the “Provider”). They are applicable to both in-person and mobile individual sessions, group offerings, workshops, retreats, online courses, as well as the purchase of vouchers and products (in the studio or via the online shop).
2. Type of Services
- Wellness massages (not a substitute for medical or therapeutic treatments)
- Qigong and breathwork individual sessions and group classes
- Workshops, retreats and online courses (both domestically and abroad)
- Mobile services (home or hotel visits)
- Sale of vouchers and physical products (e.g. books, mats, oils)
- Preparation, consultation, individual planning, and preliminary discussions as part of the service.
3. Conclusion of Contract & Booking
- Bookings can be made in person, by phone, via email at hallo@amema.at, or through the online booking system at www.amema.at.
- A contract is formed through booking and confirmation by the provider.
- For retreats, online courses, and product orders, a deposit or full payment is required; only then is the place or order firmly reserved.
- By making the booking, the customer declares themselves to be in good health and able to participate in the service, and commits to informing of any relevant health limitations in advance.
4. Right of Withdrawal under the FAGG & Commencement of Performance
(only for consumers in distance selling transactions)
- Consumers have a 14-day right of withdrawal from the conclusion of the contract or receipt of the goods.
- At the explicit request of the customer, the provider may commence the performance of the service (e.g. planning, preliminary discussions, activation of online courses) before the expiration of this period.
- With complete fulfilment of the contract before the deadline, the right of withdrawal expires (§ 18 para 1 no 1 FAGG).
- Services already rendered are to be compensated on a pro-rata basis.
- For digital content (e.g., online courses), the right of withdrawal expires upon activation if the customer expressly agrees (§ 18 (1) (11) FAGG).
- The cancellation must be made in writing or via email to hallo@amema.at.
5. Health & Personal Responsibility
- Participation is at your own risk.
- The provider does not replace medical or therapeutic treatment.
- In the case of health issues or contraindications, the provider must be notified in advance.
6. Appointments & Cancellation Policy
a) Massages (stationary & mobile)
- Free cancellation up to 48 hours before the appointment.
- Cancellation 48–24 hours before the appointment: 50% of the fee.
- Cancellation less than 24 hours in advance or failure to attend: 80%
- After consultation, a substitute participant can be designated.
- For mobile appointments, any additional travel expenses can be reimbursed.
b) Individual one-to-one sessions (Qigong, Breathwork, etc.)
- Free cancellation up to 7 days before the appointment.
- Cancellation 7–2 days before the appointment: 50% of the fee.
- Cancellation less than 48 hours or failure to attend: 80%
- Justification: Extensive individual preparation, planning, and preliminary discussions are included in the service.
c) Workshops & Group Courses
- Free cancellation up to 7 days before the start.
- Cancellation 4–2 days before the start: 50% of the fee.
- Cancellation less than 2 days or no-show: 100%
d) Retreats
- Free cancellation up to 30 days before the start.
- Cancellation 30–14 days: 50%
- Cancellation 14–7 days: 75%
- Cancellation less than 7 days or no-show: 100%
- After consultation, a substitute participant can be designated.
e) Online Courses
- Free cancellation or withdrawal is possible before activation.
- Once the course content has been activated, no cancellations or refunds will be permitted (the right of withdrawal ceases).
7. Scope of Services & Preparation
Preliminary discussions, material preparation, organisation of locations, and course materials are all part of the service. For retreats and online courses, the service often begins as soon as booking is completed.
8. Payment Terms
- Individual sessions: Payment on-site in cash or via bank transfer.
- Retreats, online courses, products: payment in advance as per the announcement.
- Vouchers: Payment required before handover or dispatch.
9. Cancellation by the provider
The provider may cancel or postpone appointments or events for significant reasons (e.g. illness, force majeure). Any amounts already paid will be fully refunded. Further claims are excluded.
10. Liability
The provider is only liable for damages caused intentionally or through gross negligence. No liability is accepted for self-inflicted injuries or for customers’ valuables.
11. Data Protection
Personal data will only be processed for the purposes of contract fulfilment, organisation, and communication. There will be no disclosure to third parties, except when necessary for implementation (e.g. hotels during retreats). The provisions of the GDPR and the Austrian Data Protection Act (DSG 2018) apply. 12. Applicable Law & Jurisdiction
Austrian law applies. For consumers, the legal venue is determined by the KSchG. For entrepreneurs, the venue is Jenbach, Tyrol.
13. Vouchers
- Vouchers are valid for 5 years from the date of issue (§ 1478 ABGB).
- Vouchers are transferable, and cash redemption is excluded.
- The provider accepts no liability for loss.
- Vouchers can be redeemed for all current services, except for special promotions that are explicitly excluded.
14. Online Shop & Products
- The contract is concluded by placing an order in the shop and confirmation by the supplier.
- Retention of title: Goods remain the property of the supplier until full payment is received.
- Consumers have a 14-day right of withdrawal from the receipt of goods.
- The customer bears the return costs unless otherwise agreed.
- Goods must be returned unused, in their original packaging, and complete.
- The statutory warranty rights apply.
15. Severability Clause
If any provision of these Terms and Conditions is or becomes invalid, the validity of the remaining provisions shall remain unaffected.
